Swink is a platform that enables users to connect with other individuals for recreational tennis activities. Swink does not organize, supervise, host, or guarantee any matches, meetings, or interactions between users.

Swink provides communication and discovery tools only.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that:

• You meet the age requirement
• You have the legal capacity to agree to these Terms
• All information you provide is accurate

We reserve the right to suspend or terminate accounts that do not meet eligibility requirements.

3. User Responsibility

You are solely responsible for:

• Your interactions with other users
• Deciding whether to meet another user
• Your conduct during any in-person meeting
• Choosing safe locations and times
• Complying with applicable laws and rules

Swink does not verify users, conduct background checks, or guarantee the identity, skill level, or conduct of any user.

You assume all risk when interacting with other users.

4. Safety Disclaimer

Swink does not screen users or monitor offline interactions. You agree that:

• You meet others at your own risk
• Swink is not responsible for user behavior
• Swink is not responsible for injuries, damages, or disputes arising from meetings

You are encouraged to use common sense and prioritize personal safety.

5. User Content

You are responsible for any content you provide, including:

• Profile information
• Photos
• Messages
• Ratings (if applicable in future features)

You agree not to post content that:

• Is false or misleading
• Is abusive, harassing, or threatening
• Violates any law
• Infringes intellectual property rights
• Contains sensitive personal information of others

We reserve the right (but not the obligation) to remove content.

6. Prohibited Conduct

You agree not to:

• Use the App for commercial solicitation
• Harass or threaten other users
• Impersonate another person
• Attempt to gain unauthorized access to the App
• Use automated tools to scrape or collect data
• Circumvent any security measures
• Use the App for unlawful purposes

We may suspend or terminate accounts for violations.

7. Account Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

You may stop using the App at any time.

8. No Warranty

The App is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Swink disclaims all warranties, including:

• Fitness for a particular purpose
• Merchantability
• Non-infringement
• Availability or reliability of the App

We do not guarantee that:

• You will find tennis partners
• Users will respond to requests
• The App will be uninterrupted
• The App will be error-free

9. Limitation of Liability

To the fullest extent permitted by law, Swink shall not be liable for:

• Injuries occurring during tennis activities
• Disputes between users
• Personal property damage
• Emotional distress
• Lost profits or indirect damages
• User conduct

Your use of the App and interactions with other users are at your own risk.

If liability cannot be excluded, our total liability shall not exceed the amount you paid to use the App, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Swink and its owners, officers, and affiliates from any claims, damages, or expenses arising from:

• Your use of the App
• Your interactions with other users
• Your violation of these Terms
• Your violation of applicable law

11. Third-Party Services

The App may rely on third-party services (such as hosting, messaging, or analytics). Swink is not responsible for the availability or performance of third-party services.

12. Changes to the App

We may modify, suspend, or discontinue the App at any time without notice. We are not liable for any resulting impact.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by the laws of Delaware, without regard to conflict of law principles.
